Atmos CBD is often asked whether our cannabidiol (CBD) products can be legally purchased and owned within the United States. 

The answer is YES.  

All hemp-derived CBD products from Atmos CBD are legal for purchase by anyone 18 or over in all 50 US states.

Know Your Rights
In December of 2018, the Agriculture Improvement Act of 2018 (also known as the “2018 Farm Bill”) was passed by the United States Congress. This piece of legislation legalizes hemp cultivation and declassifies hemp as a Schedule I controlled substance. It defines “hemp” as any derivative of the Cannabis Sativa plant that contains less than 0.3% THC. For a CBD product to be legal in the United States, it must contain less than 0.3% THC by weight and be manufactured by a licensed producer. Some US states do not recognize hemp-based CBD as a legal substance. With that said, it is illegal for any hemp-derived CBD to be seized by local or state police. Due to federal regulation, no legal action can be taken due to an individual’s possession of a product that contains isolated, hemp-based CBD.
CBD vs. THC vs. Hemp
There is plenty of confusion surrounding how hemp, marijuana, THC, and CBD are related. Many people – including lawmakers! – are confused as to the difference. As legislation surrounding their possession continually changes, it’s important to have a basic understanding of their differences.

For years, the public considered hemp and marijuana synonymous – however we now know that simply isn’t the case. Hemp and Marijuana are both plants that belong to the genus “cannabis,” but that is where their similarities end. Marijuana plants contain up to 30% of an intoxicating compound called Delta-9-Tetrahydrocannabinol, or THC. These high levels of THC are what cause users to become “high” when this plant is smoked or ingested.

In contrast, industrially grown hemp is a member of the species Cannabis Sativa that is not used as a recreational drug. This type of plant contains high levels of a cannabinoid known as CBD. Although these plants may contain trace amounts of THC (0.3%), it is simply impossible for hemp plants or their derivatives to get users “high.” Instead, CBD provides a variety of health benefits that depend upon the type of product and how it is used. You will always maintain a clear, sober mind when using Atmos CBD.
